2.2 Information We Collect Automatically

You may visit our website without identifying yourself. We do not require you to provide personal information simply to browse our site. Where it is lawful and practicable to do so, you also have the option of dealing with us anonymously or using a pseudonym. You may opt out at any time by replying DELETE to any message. Reply HELP for assistance. Message and data rates may apply. Message frequency varies.
4. How We Hold and Protect Your Information
We implement a range of security measures to maintain the safety of your personal information when you enter, submit, or access it. These include technical, administrative, and physical safeguards appropriate to the nature of the data held, and we take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure.
When we no longer need your personal information for any purpose for which it may be used or disclosed, and we are not required by law to retain it, we will take reasonable steps to destroy or de-identify it.
However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
4.1 Notifiable Data Breaches
We comply with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988 (Cth). If we become aware of a data breach that is likely to result in serious harm to any individual whose personal information is involved, we will assess the breach and, where required, notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable.
5. Cookies and Tracking Technologies
Cookies are small files that a website or its service provider transfers to your device through your web browser (if you allow) that enable the site’s systems to recognise your browser and capture and remember certain information.
We use cookies and similar technologies to:
- Understand and save your preferences for future visits
- Track and measure advertising performance
- Compile aggregate data about site traffic and interactions to offer better site experiences and tools
We may engage third-party service providers (such as analytics and advertising platforms) to help us understand our site visitors. These providers are not permitted to use information collected on our behalf except to help us conduct and improve our business. You can set your browser to refuse some or all cookies, or to alert you when cookies are being sent. If you disable cookies, some features of our site may not function correctly.
6. Disclosure of Your Personal Information
We do not sell or rent your personal information. We may disclose your personal information in the following circumstances:
- To trusted third-party service providers who assist us in operating our website, conducting our business, or servicing you (for example, hosting, email and SMS platforms, payment processors, and analytics providers), provided they handle your information consistently with this policy
- Where you have consented to the disclosure
- Where required or authorised by law, or to enforce our policies, or to protect the rights, property, or safety of Prado Digital, our clients, or others
Aggregated or de-identified information that does not identify you may be provided to third parties for marketing, advertising, analytics, or other uses.
6.1 SMS Data — No Third-Party Sharing
We explicitly confirm that mobile phone numbers collected for SMS communications, and the associated opt-in consent records, will NOT be sold, rented, shared, or transferred to any third party for marketing purposes. SMS consent is specific to Prado Digital and will only be used to deliver the communications you have specifically opted in to receive.
6.2 Overseas Disclosure
Some of the third-party service providers we use (for example, cloud hosting, email, analytics, and SMS platforms) may store or process data on servers located outside Australia, including in countries such as the United States. Where we disclose personal information to overseas recipients, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles. By providing your personal information to us, you consent to it being disclosed to and stored by such recipients where necessary to provide our services.
6.3 Personal Information We Handle on Behalf of Business Clients
In addition to the personal information we collect for our own purposes, we sometimes act as a service provider to our business clients. In these cases, a client may engage us to send communications (including email and SMS) to that client’s own contacts on the client’s behalf, or to otherwise handle personal information the client provides to us.
Where we act in this capacity, the personal information remains under the control of our client, and the client is responsible for ensuring it has obtained the necessary consents and has the right to engage us to contact those individuals. We handle that information only in accordance with the client’s instructions, our agreement with the client, and applicable law (including the Spam Act 2003 (Cth) and the Privacy Act 1988 (Cth)), as well as the protections described in this policy. Every marketing message we send on a client’s behalf identifies the client as the authorising sender and includes a simple way to opt out.
This is separate from the personal information you provide to us directly, which is dealt with elsewhere in this policy, including the SMS protections described in Section 6.1.
7. Direct Marketing and Your Consent
By providing your contact details and opting in to receive communications from us, you consent to receiving direct marketing communications (including recurring SMS/MMS and emails) from Prado Digital. Consent is not a condition of purchasing any goods or services.
We send these communications in accordance with the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), and the Do Not Call Register Act 2006 (Cth). You may opt out or unsubscribe at any time by replying DELETE to any text message, using the unsubscribe link in any email, or contacting us using the details in Section 13. Message and data rates may apply, and message frequency varies. We will action your request to stop receiving marketing communications as soon as practicable.
8. Third-Party Links
At our discretion, we may include or offer third-party products or services on our website. These third-party sites have their own separate and independent privacy policies. We have no responsibility or liability for the content or activities of those linked sites. We encourage you to review the privacy policy of any third-party site you visit.
9. Your Privacy Rights
Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the right to:
- Access the personal information we hold about you
- Correction of personal information that is inaccurate, out of date, incomplete, irrelevant, or misleading
- Withdraw consent to receiving marketing communications at any time
- Make a complaint if you believe we have breached the Australian Privacy Principles
- Anonymity or pseudonymity where it is lawful and practicable for us to deal with you that way
To exercise any of these rights, please contact us using the details in Section 13 below. We will respond to your request within a reasonable period. There is generally no charge for making a request, although we may charge a reasonable fee for giving access to information in certain circumstances. If we refuse a request for access or correction, we will give you written reasons and information about how to complain.
10. Data Retention
We retain your personal information only for as long as necessary to fulfil the purposes for which it was collected, including to satisfy any legal, accounting, tax, or reporting obligations. When it is no longer required and we are not legally required to keep it, we will take reasonable steps to destroy or de-identify it.
SMS opt-in records (including the mobile number, consent timestamp, and opt-in source) are retained for as long as you remain opted in, and for a reasonable period afterwards, to demonstrate compliance with applicable laws, or until you request deletion, whichever is later.
11. Children’s Privacy
Our website, products, and services are directed to individuals who are at least 18 years of age. We do not knowingly collect personal information from anyone under 18. If you believe we have inadvertently collected information from a person under 18, please contact us and we will take reasonable steps to delete that information.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page. We encourage you to review this policy periodically to stay informed about how we are protecting your information. Your continued use of our website after any changes constitutes your acceptance of the updated policy.
